1. Introduction

These Terms of Service govern your access to and use of the MC-TERRA platform (the "Service") provided by:

MC-TERRA is a therapeutic coaching and emotional well-being platform. By accessing and using our platform, you agree to these terms. If you do not agree to these terms, please do not use the Service.

2. Definitions

Platform: the MC-TERRA website and mobile application
Service: all services offered, including coaching, video courses, workshops, retreats, and product sales
User: any person who has created an account on the Platform
Session: an individual coaching session conducted in person, online, or by phone
Content: all documents, videos, exercises, and materials provided by MC-TERRA

3. Services Offered

MC-TERRA provides the following services:

Individual coaching: therapeutic and emotional coaching sessions (in person in Rolle, online, or by phone)
Workshops and retreats: group events for personal development and well-being
Content platform: access to video courses, exercises, emotional journal, and mood tracking
E-commerce: sale of doTERRA essential oils and monthly batch orders
Booking system: appointment management and cancellations

All services are provided by Marta Coelho, a certified personal development coach. The services do not constitute medical treatment or medical therapy. If you suffer from serious mental or physical health issues, please consult a qualified healthcare professional.

4. User Registration and Account

4.1 Access Requirements

To use the Service, you must:

Be at least 18 years old, or have written parental consent
Provide accurate and complete information during registration
Maintain confidentiality of your login credentials
Be responsible for all activity under your account

4.2 User Obligations

You agree to:

Not use the Platform for illegal or unethical purposes
Respect copyright and intellectual property rights
Not share your account with other persons
Notify MC-TERRA of any security breach or unauthorized access

5. Bookings and Cancellations

5.1 Booking Process

Bookings are made through the integrated booking system on the Platform. A confirmation will be sent to your email after your booking is validated.

5.2 Cancellation Policy

Free: cancellation up to 24 hours before the session
Paid: cancellation less than 24 hours before the session results in full session charge
Cancellations must be made via the Platform or by email to contact@mc-terra.ch

5.3 No-Shows

If you do not show up for a scheduled session without notice, the session will be charged in full.

6. Payments

6.1 Payment Method

Payments are processed via Stripe. Your payment information is secure and encrypted. MC-TERRA does not store your banking data.

6.2 Pricing

Prices are displayed before confirmation of your order or booking. All prices are in Swiss francs (CHF). MC-TERRA is not subject to VAT (revenue below the legal threshold of CHF 100,000).

6.3 Refunds

Refund requests are processed in accordance with the cancellation policy (section 5.2). Refunds are issued within 7-10 business days.

7. E-commerce and Delivery

7.1 Orders and Monthly Batches

MC-TERRA sells doTERRA products (essential oils and wellness) through the online shop. Orders are grouped into monthly batches and placed with doTERRA on the 12th of each month. Any order paid before the 12th is included in the current month's batch; after that date, it is carried over to the following month.

7.2 Delivery Methods

Two delivery options are available:

Office pickup (free): Route de Gilly 30, 1180 Rolle. Available by appointment or during your next session, approximately 5 to 10 days after the doTERRA order is placed.
La Poste shipping (CHF 7.00): home delivery in Switzerland, within 1-2 business days after product receipt. A La Poste tracking number will be sent to you by email.

7.3 Return Policy

You have 14 calendar days from receipt to return a product, subject to the following conditions:

The product must be unopened and in its original packaging
Return shipping costs are the customer's responsibility
Refunds are issued within 7-10 business days after the return is received

Opened or used products cannot be returned, in accordance with hygiene requirements for essential oils and personal care products.

7.4 Order Cancellation

You may cancel your order as long as it has not yet been ordered from doTERRA (status "paid"). Once the status changes to "ordered", cancellation is no longer possible. For any requests, contact us at contact@mc-terra.ch.

8. Events and Retreats

8.1 Registration

Registration for events and retreats is completed through the Platform. A confirmation email is sent after your registration is validated. Spots are limited and allocated on a first-come, first-served basis.

8.2 Waitlist

When an event is fully booked, you may register on the waitlist. If a spot becomes available, you will be automatically notified by email.

8.3 Cancellation Policy

Free events: cancellation up to 48 hours before the event start
Paid events: cancellation less than 48 hours before the event results in full charge
Cancellations must be made via the link provided in the confirmation email or by email to contact@mc-terra.ch

8.4 Cancellation by MC-TERRA

MC-TERRA reserves the right to cancel an event in case of force majeure or insufficient number of participants. In such cases, registered participants will be fully refunded within 7-10 business days.

9. Gift Cards

9.1 Purchase and Validity

Gift cards are available for purchase through the Platform. Two types are offered:

Session gift card: valid for a specific service (e.g., discovery session, emotional therapy)
Open amount gift card: valid for a Swiss franc amount, usable for all services

Each gift card is valid for 12 months from the date of purchase.

9.2 Usage

The gift card is identified by a unique code sent by email to the buyer
The recipient can use the code during a booking or purchase on the Platform
An open amount gift card can be used multiple times until the balance is exhausted
A session gift card can be used once for the corresponding service

9.3 Conditions

Gift cards are non-refundable after purchase
Gift cards cannot be exchanged for cash
Expired gift cards cannot be reactivated
MC-TERRA is not responsible in case of loss of the code by the buyer or recipient

10. Intellectual Property

10.1 MC-TERRA Content

All content (texts, videos, exercises, images, designs) provided by MC-TERRA is protected by copyright. You receive a personal, non-transferable, and revocable license for private use only.

10.2 Prohibited Use

You may not:

Reproduce or distribute content without written authorization
Create derivative works based on the content
Resell or rent access to the Service

10.3 User Content

By uploading content to your emotional journal, you grant us a license to process it as necessary for the Service to function, while retaining your rights to that content.

11. Liability and Limitations

11.1 Nature of the Service

MC-TERRA is a coaching and well-being service. The services are not medical treatments, professional psychological therapy, or clinical therapy. MC-TERRA is not a licensed healthcare professional under Swiss law.

11.2 Limitation of Liability

MC-TERRA is not liable for:

Loss of data or access to the Platform
Indirect or consequential damages arising from use of the Service
Results from using coaching or exercises
Technical interruptions or server downtime

11.3 Warranty Disclaimer

The Platform is provided "as is" without implied warranties. MC-TERRA does not warrant that the Service will meet your needs or operate without interruption.

11.4 Medical Disclaimer

You acknowledge that:

MC-TERRA is not a substitute for medical care or professional therapy
In case of mental health crisis or emergency, contact relevant authorities or emergency services immediately
Consult a physician before making changes to your medical treatment or medications

12. Personal Data

The processing of your personal data is governed by our Privacy Policy (see dedicated page). By using the Platform, you agree to the processing of your data in accordance with that policy.

13. Modification of Terms

MC-TERRA reserves the right to modify these terms at any time. Modifications will be posted on this page with a new update date. Continued use of the Service after modification means you accept the modified terms.

14. Governing Law and Jurisdiction

These terms are governed by Swiss law (Canton of Vaud). Any dispute shall be subject to the jurisdiction of the courts of Nyon, Vaud, Switzerland.
